Young woman who left Portugal by order of AIMA wins in court and can return

A Brazilian woman who was forced to leave Portugal after an AIMA residency denial has successfully appealed the decision in court. Her name has been removed from the Schengen Information System (SIS), allowing her to legally return to Portugal.

Why it matters

This court ruling sets a legal precedent that may assist other foreign residents who were issued an expulsion order by AIMA and wish to contest it to regain their right to reside in Portugal.

Over 27,000 immigrants were issued notices to leave Portugal in 2026, with only about 800 voluntary departures recorded. New legislation will remove the voluntary departure notification process, making removal compulsory and allowing police to detain individuals to initiate forced removal proceedings if they fail to leave.
