Government has 180 days to change the legal regime for undivided inheritances

A new law (Law 49/2026) authorizes the Government to create a special procedure allowing a single heir to request the sale of a property held in an undivided inheritance, even without agreement from other heirs. This applies to all open and undivided inheritances at the time the new rules enter into force, though it explicitly excludes family homes unless the surviving spouse or partner provides express consent.
