Administrative courts warn of pressure caused by new deportation rules
New deportation rules, set to take effect in the coming days, remove the automatic suspensive effect of judicial appeals for asylum seekers. This shift means that to prevent immediate deportation while an appeal is pending, applicants must now file a separate 'provisional injunction' (providência cautelar) in addition to the main legal action, potentially doubling the number of cases in administrative courts.
Why it mattersIf you are an asylum seeker, the new rules mean that challenging a deportation decision no longer automatically keeps you in Portugal during the process; you must now specifically request a court injunction to secure your stay, which increases both the legal urgency and the procedural complexity of your case.
